With the adoption of an expanded General Block Exemption Regulation, new block exemptions for agriculture and for fisheries and moves underway for a Block exemption regulation in the area of land transport, it is more important than ever for national authorities to be aware of their role in relation to the award of and the monitoring of aid measures. The first day of this expert seminar will address a series of issues with which national authorities can be confronted in that domain, ranging from the possibilities that exist to provide public support that does not constitute aid or that is aid exempted from notification to the Commission, to the questions they face where an applicant for aid asserts that those authorities breached the applicable rules in refusing their applications.

At the same time, at the level of the Union, there is the advent of a new legal instrument intended to fill what many commentators say as a gap in protecting the internal market from public financial support originating outside the Union. The Foreign Subsidies Regulation (‘FSR’) entered into force on 12 January 2023 and its provisions on notifications apply since 12 October 2023. Some nine months after the Commission began to receive notifications and declarations on foreign financial contributions in connection with mergers and public tenders, what are the initial signs of how the FSR is functioning to protect the level playing field, and what significance does it have for national contracting authorities, for tenderers and for undertakings involved in merger activities.
